Nnamdi Kanu Release Date Today
Justice James Omotosho of the Federal High Court in Abuja has stood down proceedings in the ongoing trial of Nnamdi Kanu, leader of the proscribed Indigenous People of Biafra (IPOB). The judge deferred ruling on a motion seeking Kanu’s transfer to the National Hospital, Abuja for medical attention.
During Friday’s resumed hearing, Onyechi Ikpeazu, SAN, counsel for Kanu, argued that documentary evidence supports their motion for a hospital transfer. He cited a medical report by Professor Austin Agaji, which stated that Kanu required further treatment at the National Hospital, Abuja.
Opposing the motion, Chief Adegboyega Awomolo, SAN, counsel for the Federal Government, filed a counter-affidavit on September 15. He urged the court to refuse Kanu’s request, stating that the Department of State Services (DSS) had complied fully with previous court orders regarding Kanu’s medical care.
“Your lordship made an order that the defendant should be allowed to see any of his relations, any doctor of his choice and his lawyers. All these were obeyed,” Awomolo noted.
Awomolo added that the DSS had even allowed Kanu access to medical facilities of his choice. However, he warned that transferring Kanu to the National Hospital could pose a security risk, given that the IPOB leader is regarded as a flight risk and may attract potential attacks at the facility.
The Federal Government also questioned the credibility of Prof. Agaji’s report, pointing out that the medical expert neither works at the National Hospital nor provided evidence that Kanu’s current treatment was ineffective. Awomolo described the health claims as “exaggerated” and “in bad faith,” suggesting they were aimed at creating a false narrative about Kanu’s condition.
Awomolo informed the court that the DSS had set up a seven-member panel of medical experts from the Nigerian Medical Association (NMA) to independently evaluate Kanu’s medical fitness within one week. This, he said, would provide an unbiased assessment of Kanu’s health.
In response, Ikpeazu stated that he was not aware of the panel’s composition. When Justice Omotosho asked if he would agree to allow the NMA panel to issue an independent report, Ikpeazu said he would, provided the court made such an order.
After hearing arguments from both sides, Justice Omotosho decided to stand down the matter for ruling. The next steps in the case will be determined once the judge delivers his decision on Kanu’s medical transfer motion.
